Impressum Requirement for German Websites — What Every Business Must Include

The Impressum is one of the most misunderstood legal requirements in German web law. Many business owners assume a brief contact page or a general "About" section is sufficient. It is not. The Telemediengesetz (TMG) §5 is precise about what must appear, and non-compliance carries genuine legal and financial consequences.

What the Law Requires: §5 TMG

Under Telemediengesetz §5, any person or entity offering telemedia services for commercial purposes — which includes any business website — must make the following information easily accessible, clearly labelled, and permanently available:

  • Full legal name: The registered name of the natural person or legal entity, not a trading name alone
  • Registered address: A physical postal address — a P.O. box is not legally sufficient
  • Direct contact details: An email address that is checked and can receive communications; a contact form alone does not satisfy this requirement
  • Phone number: A direct line for rapid electronic communication — required since the 2022 amendment to §5 TMG
  • Handelsregisternummer: Commercial register number and the registry court name, for registered companies (GmbH, AG, etc.)
  • USt-IdNr: VAT identification number, if applicable
  • Authorised representative: For GmbHs and AGs, the name(s) of Geschäftsführer or Vorstand members
  • Regulated profession details: For doctors, lawyers, architects and other regulated professions — professional chamber, title awarded, and applicable regulatory law

The Abmahnung Risk

Germany has a well-established Abmahnwesen — a legal practice where competitors or specialist Abmahn law firms send formal warning letters to websites with deficient legal notices. An Abmahnung demands immediate correction and typically includes a claim for legal fees ranging from €150 to €500 or more for a simple Impressum violation.

Repeat violations, ignored Abmahnungen, or court-issued Unterlassungserklärungen (cease and desist orders) escalate costs significantly. The Abmahnung industry in Germany is active and automated — bots regularly crawl websites looking for missing or incomplete Impressum pages.

The Impressum and DSGVO Are Separate Requirements

A common mistake is conflating the Impressum with the Datenschutzerklärung (privacy policy). They are two distinct legal documents, both required, and both must appear as separately accessible pages — typically linked in the footer of every page on the website.

Your Datenschutzerklärung must detail every data processing activity on the site: contact forms, Google Analytics, embedded maps, YouTube videos, newsletter tools, and any cookies. German data protection authorities (Datenschutzbehörden) have issued warnings and fines for missing or outdated privacy policies alongside Impressum violations.

Where the Impressum Must Appear

The law requires the Impressum to be accessible in no more than two clicks from any page on the website. Standard practice is a footer link labelled "Impressum" on every page. Burying it inside a contact page or FAQ section is legally risky. The label must be recognisable — German courts have ruled that labels like "Legal Notice" in English are not sufficient for German-language sites.

Is a contact form sufficient instead of a direct email address in the Impressum?
No. Since 2022, the §5 TMG reform explicitly requires a direct email address and a telephone number. A contact form is considered a supplementary channel, not a primary contact method, and does not satisfy the legal requirement on its own.
